2nd entry

September 2nd, 2018 at 07:49 pm

I have a bit of time today (ok, so I'm procrastinating on doing other stuff I should be doing ….)

So in addition to the yardwork drama of this past week, we had some additional drama. I'm not sure exactly how this is going to play out.

It may turn out to be nothing more than increased premiums, or it could be really, really bad.

My DH got into an accident while out on a delivery this week.

He was making a right hand turn, and at the same time a bicyclist started crossing.

The bicyclist got taken away in an ambulance - but only had apparent injuries to her knee.

DH doesn't want to attempt to report this to the owner's insurance because he's afraid the owner will get angry and fire him for being a pain. Apparently no other driver has attempted to report accidents on the job for a similar reason.

When DH got in the fender bender last year, I didn't try to push it since it was minor and no injuries. This time though there are injuries.

He only keeps $50k liability limit on his cars.

I'm having nightmares of all our assets vanishing.

I called my agent about umbrella insurance, but was told they couldn't do it with an open claim (not surprising) and we'd both have to up our liability limits.

So .. all I can do now is pray that this lady is not litigious, and that $50k will cover her injuries.

I'm also hoping that DH doesn't have another claim anytime soon - because then he might lose his insurance!

I'm so sorry this happened. Hopefully she isn't litigious.

I'm sorry you have that hanging over your head, and I hope that all works out.

Could reporting it to the owner's insurance be your back-up plan? If $50k isn't enough?

Jenn - if I can convince him to do it, definitely.

Was a police report filed? The cyclist's insurance will get a copy and contact your husband. They will ask about where he was driving to at the time of accident. He can either lie about it and you will be responsible for this woman's injuries or he will tell them he was working and they will contact his employer. Do the right thing, this won't just disappear. Is a pizza delivery job worth that much?

    A police report was filed.

I don’t know what he plans on saying about it.

His job is almost half our income. So definitely not unimportant or inconsequential. And not easily replaced for a number of reasons.

Also, they won’t necessarily ask where he was going. I wasn’t asked that when I had a fender bender this winter.

You’re willing to lie and risk your own finances to protect a shady employer who would fire someone for doing the right, legal thing?
A fender bender is very different than an accident with a victim in an ambulance. Insurance companies do not want to take on a liability that they don’t have to, they will investigate this. So will the ambulance chaser lawyers.
I was a witness to this exact type of accident. Cyclist appeared to have only scrapes and refused the ambulance. Two years later I was in court as a witness. Hundreds of thousands of dollars of medical bills and liability were at stake.
Whatever decision you make, be prepared to live with it for a long time.

No advice, just hugs to you. You've had a fair amount of stress lately and I hope your vacation gives you the rejuvenation and reflection time you deserve.

Lurker - DH has spoken to the police, to his insurance, to an insurance adjustor - none of them asked him if he was driving for business or pleasure.

After talking tonight, he has said he will talk to his insurance tomorrow and see what they think. He thinks I'm being a worry wart, and is only doing this to ease my mind.

    Kashi,

Thank you. I hope so too.

To add to everything, Kari has *another* UTI. This means I get to make a 2 hour round trip drive tomorrow to the cheap vet clinic to pick up more meds for her. And DH is going to have to deal with giving her the meds while I'm gone … My being gone isn't going to help her stress levels any - which I think is THE main contributing factor to her recurrent UTI's.

Oh, and I got a call today from one of the applications I put out. I got through the first question and was politely declined - since I wasn't available Saturdays. They needed someone Saturday - Wednesday. Ugh. It would've paid $2+/hr more. to start. To make it more interesting - I got the call while eating lunch in the breakroom with my now direct supervisor. Err...
